ShineDay Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of ShineDay, including the ShineDay Android application and related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service and should stop using it immediately.

2. Eligibility

You must be at least 13 years old to use the Service.

If you are under the age of legal majority in your jurisdiction, you may use the Service only with permission and supervision of a parent or legal guardian, and that parent or guardian agrees to be responsible for your use of the Service, to the extent required by applicable law.

3. Account and Access

Certain features may require account access, including Google Sign-In and related account linkage functionality.

You are responsible for:

  • Maintaining the security of your account and credentials.
  • Ensuring your account information is accurate and up to date.
  • Promptly notifying us at myshineday@gmail.com if you believe your account has been compromised or used without authorization.

ShineDay may provide in-app account unlinking or deletion controls. Your use of account features is subject to these Terms and applicable third-party account provider terms.

4. Subscriptions, Purchases, and Billing

ShineDay may offer paid digital features and membership options, which may include plans such as yearly and lifetime access. Plan availability, pricing, and feature scope may vary by region, platform, and time.

Purchases, billing, renewals, and payment processing for in-app digital products are managed through Google Play and are subject to Google Play terms and policies.

The Service includes "Restore Purchases" functionality to recover eligible purchases where supported by Google Play and your account status.

Refund requests and billing disputes for in-app purchases should be submitted through Google Play's refund and support processes. We do not directly process store payment refunds.

5. License and Permitted Use

Subject to your compliance with these Terms, ShineDay grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for lawful, non-commercial use.

You may not use the Service for unauthorized commercial exploitation, resale, or distribution.

6. User Content and Data

You retain rights to content and data you create or submit through the Service (for example, notes, habits, records, and other user-entered content).

You grant ShineDay a limited, non-exclusive license to host, store, process, transmit, back up, synchronize, and display such content solely as reasonably necessary to operate, maintain, and improve the Service.

7. Prohibited Conduct

You agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the Service except where expressly permitted by applicable law.
  • Bypass, disable, or interfere with security or access control mechanisms.
  • Use the Service in a way that violates law, regulation, or third-party rights.
  • Abuse, overload, probe, or disrupt the Service, networks, or related infrastructure.
  • Use unauthorized automation, scripts, bots, or scraping methods in a manner that harms Service stability, availability, or other users.
  • Use the Service to distribute malware, harmful code, or fraudulent content.

8. Intellectual Property

The Service, including its software, code, design, layout, branding, trademarks, and documentation, is owned by ShineDay Team or its licensors and is protected by applicable intellectual property laws.

Except for the limited license granted in these Terms, no right, title, or interest in the Service or its intellectual property is transferred to you.

9. Third-Party Services

The Service may rely on third-party services, including Google Play, Google/Firebase services, and Google Drive.

Your use of third-party services is governed by those third parties' own terms, policies, and privacy practices. ShineDay is not responsible for the independent practices of third-party services.

10. Service Availability and Changes

We may update, modify, suspend, discontinue, or restrict all or part of the Service at any time, including features, integrations, or plan offerings.

We do not guarantee that the Service will always be available, uninterrupted, timely, secure, or error-free.

11. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by applicable law, ShineDay Team and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of the Service.

To the fullest extent permitted by applicable law, the total aggregate liability of ShineDay Team for all claims arising out of or related to the Service will not exceed the amount you actually paid for the Service during the 12 months immediately preceding the event giving rise to the claim.

13. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ShineDay Team, its affiliates, and service providers from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:

  • Your misuse of the Service.
  • Your violation of these Terms.
  • Your violation of applicable law or third-party rights.

14. Suspension and Termination

We may suspend or terminate your access to all or part of the Service if we reasonably believe you violated these Terms, misused the Service, or created legal, security, or operational risk.

Upon termination, your license to use the Service ends. Sections that by their nature should survive termination will survive, including but not limited to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and Contact Information.

15. Governing Law and Dispute Resolution

These Terms are governed by applicable law.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by courts of competent jurisdiction under applicable law.

These Terms do not require mandatory arbitration and do not include a class action waiver.

16. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the Effective Date above.

Your continued use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms.
